a. GENERAL TERMS

Welcome to https:/www.earthmama.gr  the e-shop of the sole trader under the name “ΕΛΕΝΗ ΔΗΜ. ΚΟΡΟΒΕΣΗ” (Tax Reg. No EL143549745, Tax Office DOI Kifisias) having its registered office in Alonion 42, Kifisia, 14562, Athens, Greece (hereafter referred to as “Earth Mama”).

By accessing, browsing or shopping on this website you agree to the Terms and Conditions that follow and we reserve the right to revise these at any time so please check them periodically and read them carefully. These Conditions set the terms of use of our website and services and the terms of the sale agreement concluded between Earth Mama and its customers.

 

b. USE OF THE WEBSITE/REGISTERED MEMBERS

By browsing this website as well as by registering as a member, submitting a request or placing an order you guarantee that you are a legally capable person under Greek law.

You can register as a member of Earth Mama by submitting the registration form online. Earth Mama reserves the right to reject the registration or to delete members at its absolute discretion for a reason (i.e. customer’s prior refusal to accept products ordered upon delivery, violation of the present Conditions, breach of the sale contract etc.).

 

c. PRIVACY AND SECURITY

In order to perform any transaction through the e-shop and to make any order or request of the products, you will be asked to provide some personal data. With the use of the website you provide your explicit consent to Earth Mama to process the relevant personal data and you declare that all the information is true and accurate.

When you place an order, you will be asked to provide your full name and surname, the address for the delivery of products, your phone number (whichever phone number you specify and you can be reached on), your email address and, in case you choose to use your credit/debit card as a payment method, you will be asked to provide the card number, its expiry date as well as the 3-digit security code of your card. If you do not provide all necessary information, we may not be able to complete your order.

Earth Mama shall lawfully process the above data in order to complete the order placed by our customers and shall in no way disclose, publish or sell these data to any third parties, except in case it is legally obliged to.

Your personal data shall be disclosed to the relevant bank (i.e. the credit card number) and shall be DELETED immediately after the completion of your order, thus ensuring a higher level of security. Please refer to our Privacy Policy for more information on our Privacy and Security Practices.

Our website uses the SSL protocol of EUROBANK for safe online business transactions. In this way, all credit card information is encrypted so that it may not be read or changed while transferred in the Internet. SSL protocol (Secure Sockets Layer) is now a global Internet standard for the certification of websites to Internet users and for the encryption of data between Internet users and web servers. An SSL encrypted communication requires all information interchanged between a customer and a server to be encrypted by the sender’s software and to be decoded by the recipient’s software; in this way, personal data are protected while transferred on the Internet. Furthermore, all information sent via SSL protocol is protected by a mechanism that automatically verifies if such data have been changed while transferred.

 

d. PRODUCT INFORMATION

Product features and other details are available online and you can find any related information by following the search guide provided in our website and by clicking on the name of the relevant product.

Earth Mama makes every effort to present the products of the website in the most accurate way possible. In some cases, the information on our website may contain inaccuracies or incomplete information. We reserve the right to correct any mistakes or to update the website anytime without prior notification. Given the live nature of our products on our website, the colours, dimensions and appearance presented on the website may differ slightly from those of the actual product.

 

e. PLACING AN ORDER 

Once you submit your order through this website you will receive an automated email to let you know that we are processing your order. We do our best to process every order however if something happens to the product you ordered, we will contact you as soon as possible to suggest a similar product. If you do not wish to order such similar products, we will cancel your order and refund you in full the amount that you may have paid.

 

f. PRICING POLICY

Prices shown on products include VAT. Your order’s final price will be calculated by product’s price and delivery fees. If there are any products on sale these will be available until exhaustion of the stock. We reserve the right to change our prices without prior notice. In any case these changes will not apply to orders already placed and upon delivery the customer will be required to pay the product price as written at the time of the order submission.

 

g. PAYMENT

We accept payments through debit or credit cards and cash or card (pos) upon delivery. We accept Visa and Master Card debit or credit cards. If you create an account, your card will be stored securely so that you can check out on future visits without re-entering your card details.

 

h. DELIVERY

We hand-deliver orders in the specific areas of Athens. Deliveries are scheduled every Thursday, unless noted otherwise, and will be made within 20 days of placing your order. We will contact you to let you know the exact date your plant will be delivered and again within 30 minutes prior of arrival on that day. i. RETURN/ CANCELATION POLICY

 

Plants & Dried Flowers

Due to the nature of plants & dried flowers, we are unable to accept returns on these products. As our products are hand delivered, we make sure that our products are in perfect shape. If the product is damaged in transit or you have received the wrong product you should notify us upon delivery or send us an email within 24 hours of receiving the product and we will offer a free replacement at our next available delivery date. Refunds cannot be made unless we fail to provide a replacement.

Items or Accessories

If you wish to return any item or accessory purchased, you may do so within 14 days of receiving the product and we will refund you the price of the product and the cost of delivery. Please note that you will bear any return costs. Should you wish to alter or cancel an order placed you can do so anytime within the above time frame.

j. INTELLECTUAL PROPERTY RIGHTS

The entire content of the website, including images, graphics, photographs, drawings, texts, products, marks, symbols, is the intellectual property of Earth Mama and is protected by the relevant provisions of Greek, European law and international conventions.

Any modification, copying, distribution, modification, configuration, transfer, sale, republication in any way of any information (in whole or in part), reproduction and retransmission, downloading or exploitation of the contents of the website in any way or by any means for commercial or other purposes is forbidden without the written permission of “Earth Mama”. The appearance of such content on the website should in no way be construed as a transfer or assignment of a license or right to use it.

 

k. FINAL TERMS

Assignment

This sale agreement and each and every covenant, term and condition herein is binding upon and endures to the benefit of the parties hereto and their respective successors.

The customer cannot assign this agreement in whole or in part; however Earth Mama may assign or subcontract the sale agreement or any other of its rights to third parties at any time during its term.

Force Majeure

The failure to perform or delay in performance of any obligation under the sale agreement solely by reason of causes beyond its control, including but not limited to: acts of God, acts of government, riots, wars, civil commotions, invasions, terrorist attacks or threat of terrorist attacks, strikes, fire, explosions,  floods, natural disasters, shall not be deemed to be a breach of the sale agreement; Our performance under any Contract is deemed to be suspended for the period that any event outside our control continues but in case the cause of delay exceeds more than sixty (60) calendar days, Earth Mama will contact you in order to terminate the sale agreement and return all the amounts paid by you.

Waiver
No waiver of any default herein by either party or any failure to enforce any rights hereunder shall be deemed to constitute a waiver of any subsequent default with respect to the same or any other provision hereof.

Severability
Should any part of this sale agreement be held unenforceable or in conflict with the applicable laws or regulations of any jurisdiction, the invalid or unenforceable part or provision shall be replaced with a provision which accomplishes, to the extent possible, the original business purpose of such part or provision in a valid and enforceable manner, and the remainder of this sale agreement shall remain binding upon the parties hereto.

Modification
Earth Mama reserves the right to modify or renew the present terms and conditions at its sole discretion.

Governing Law-Jurisdiction

The use of the website and the sale agreement shall be ruled and interpreted according to the laws of Greece.

All disputes arising out of or in connection with the use of the website or the sale agreement if not amicably settled, shall be submitted to the Courts of Athens.

Returns

Plants & Dried Flowers

We take pride in the health and high quality of our plants and do our very best to only sell and deliver healthy, thriving plants. Please make sure you contact us if you think that you haven’t been able to take care of the plant properly so we can help you. 

Dried flowers are also natural items and while they can last you for years to come, they need to be treated rightly. If you are unsure of how to take care of these delicate pretty items, please get in touch. In general, keep them out of direct sunlight and at a spot with low humidity. As they are delicate keep them out of strong airflow as they don’t like to be blown out. You can also dust them gently and spritz them lightly with hair spray to limit dropping and shedding. It is inevitable that even dried flowers will fade and change in appearance over the years, it’s just mother nature doing her thing.

Items or Accessories

If you wish to return any items or accessories purchased, you may do so within 14 days of receiving the product and we will refund you the price of the product and the cost of delivery, but please note that you will bear any return costs. Incorrect Address

Earth Mama is not responsible if the delivery is delayed due to the wrong address given at checkout. Please ensure your address is correct before checkout and that you will be home on the estimated day of delivery.

Sale items cannot be refunded.

Gift cards cannot be refunded.

Shipping FAQs

 

Which areas do you deliver to?

We are able to deliver to most of Athens depending on your post code. Delivery and packaging can be damaging to delicate plants, and we want plants to arrive safe and healthy to your door. We have included a pop-up post code search button for you as soon as you enter the website, as well as on the shopping page of each item. 

Can we order a plant without a pot or a pot without a plant? 

Our philosophy is built on creating plant and pot combinations for you, so it is easier for you to purchase a complete item, and also we believe that a plant’s aesthetic is elevated when it is placed in the right pot. We hand-pick and hand-select each combination after a lot of trial and error to ensure it brings to life the unique Earth Mama style.

What is the packaging of the plants like?

We use our crafted bags with our logo for the plants that fit in the size of our bag which is 25×32. We have crafted paper we can use for some of our plats too and our dried flowers come in a see-through paper with our logo hanging. Larger plants have no packaging as it is the most secure way to transport them to avoid damage, plus we can use less packaging which means less waste! In case of gifting, we include your handwritten message on a white card which has our logo on one side and your note on the other. We encourage you to write a message for your gift on the checkout page. 

Why can’t my plant and pot be delivered through a courier or a transport service? 

As careful as these companies may be, we find that handling of plants and flowers on the road requires considerable finesse. We have found that the arrangement will become very messy and possibly damaged in transit. You would also understand this if you have ever tried to move a plant to or from your house in a car or a van. Plants are living organisms and need care and light when on the road as the plants get shocked by moving around and find it hard to adapt to new environments. By hand-delivering each item we ensure the perfect condition of the plant, it is transferred safely, the soil stays in its place, and the pottery is intact. 

What delivery service do you use?

We currently hand-deliver everything ourselves. 

What locations are available for delivery?

We have carefully selected the post codes we can currently reach with our delivery service. However, we are always looking to expand. At the moment we hand-deliver orders in the specific areas of Athens listed in alphabetical order here: Acharnes,,Afidnes, Agia Paraskevi, Agios Dimitrios, Agios Ioannis Rentis, Alimos, Ano Liossia, Athens, Chalandri, Cholargos, Dionyssos, Drossia, Ekali, Elliniko, Filothei, Galatsi, Glyfada, Ilion, Ilioupoli, Kallithea, Keratsini, Kesariani, Kifissia, Lykovryssi, Maroussi, Melissia, Metamorfossi, Moschato, Nea Filadelfia, Nea Ionia, Nea Smyrni, Neo Iraklio, Neo Psychiko, Nikea, Paleo Faliro, Papagos, Pefki, Penteli, Piraeus, Psychiko, Tavros, Thrakomakedones, Vari, Voula,Vouliagmeni, Vrilissia, Vyronas, Ymittos, and Zografos.

What if my order arrives damaged?

As we hand deliver everything ourselves, we would know if the item you ordered has been damaged upon delivery. Of course, we do everything in our power for this not to happen. However, if the product is damaged in transit or you have received the wrong product you should notify us upon delivery or send us an email within 24 hours of receiving the product and we will offer a free replacement at our next available delivery date. Refunds cannot be made unless we fail to provide a replacement.

I placed my order, how long will it take to be delivered? 

Our delivery day at the moment is Thursday. We organise our weekly orders from Thursday to Tuesday. In the future or at busy times of the year we will add another delivery day to make sure we accommodate you better. Or we will mention if the delivery day changes due to circumstances. We have set days we deliver to minimise carbon emissions and this is why we can’t offer delivery time slots. However, we will get in touch within 30 mins of arrival. If you want your delivery date set on a different day of the week due to a birthday, new baby’s arrival, or any other reason, please get in touch and we will sort it out.

Why do you deliver on set days of the week?

We are very conscious and mindful about the way we do our deliveries. We have set days we deliver to minimise carbon emissions and this is why we can’t offer delivery time slots. This also means we have fewer vans on the road, and we can keep the delivery charge low. However, we do get in touch within 30 mins of arrival to let you know that we are on our way to you. If you want your delivery date set on a different day of the week due to a birthday, new baby’s arrival, or any other reason, please get in touch and of course we understand, and we will look to accommodate you.

What days do you deliver?

At this time, we are doing contactless delivering for your orders on Thursdays from 9am-10pm, unless noted otherwise. When checking out, please let us know the preferred time you would like your order to arrive and look into doing our best to accommodate you. 

Will I receive a notification when the delivery is en route?

Yes, we will get in touch when the delivery is en route. This is usually within 30 minutes of arrival. Be sure to include your phone number at checkout so we are able to contact you. Please be available to meet the delivery person immediately. We are not responsible for packages left at the door or in the building lobby if you are unavailable to meet the driver and retrieve your package. 

Will you enter my building with the delivery? 

During this time, we prefer not to enter any buildings and it would be great if you would step outside to receive your order. Also, we will need your help to bring large plants up to your home. We hope that this will change soon but for the safety of everyone we continue to practice social distancing. 

What happens if I haven’t received my order on the day it is was set for delivery?

If we have set the day of delivery and the plant hasn’t arrived on the day we promised please get in touch with us straight away and we will discuss the next available time we can deliver. Please bear in mind that we will get in touch within 30 mins of arrival. Our deliveries start at 9am and finish on 10pm, unless noted otherwise. If you require specific time and day of delivery for whatever reason, please get in touch so we can discuss availability. 

When will I know when I will receive my order?

We will get in touch with you within 2-3 working days to let you know on which day you will receive your order. We have set days we deliver to minimise carbon emissions and this is why we can’t offer delivery time slots. We will get in touch when the delivery is en route. This is usually within 30 minutes of arrival. Be sure to include your phone number at checkout so we are able to contact you. We may also need to notify you when we arrive. However, if you prefer a different date & time of delivery please get in touch with us and we will do our best to deliver at your preferred timings.Â
